Terms of Use
1. Who we are and what casewise is
1.1 casewise is an AI-powered educational study tool for legal study and general legal research, operated from New South Wales, Australia. casewise is operated by CaseWise Technologies Pty Ltd ("we", "us", "the operator"). You can contact us at info@gocasewise.com.
1.2 casewise is not a law firm and not a legal service. It does not provide legal advice, does not act for you, and no solicitor-client, fiduciary or professional relationship is created by your use of it. Nothing in the service is a substitute for advice from a qualified lawyer.
1.3 casewise generates content with artificial-intelligence models. AI output can be incomplete, inaccurate or out of date. You must verify every authority, citation and proposition against primary sources before relying on it.
2. The educational-use boundary
2.1 The supported use of casewise is education, hypothetical work and general legal research: studying, issue-spotting, drafting practice, understanding legislation and judgments, and locating primary sources.
2.2 You must not use casewise to obtain advice for a real person, client, dispute, deadline or court matter, to prepare documents for filing or reliance, or as professional legal work product.
2.3 Lawyers and other practitioners may hold accounts, but the current service supports general research only. Practitioners remain responsible for independently checking every authority and output and for complying with their professional and court obligations. The service is not a professional legal-work platform and must not be used for client matter work. If you tell us at onboarding that you are a lawyer, we ask you to acknowledge that the current service is an educational and general legal research tool and not a professional legal-work platform, and we record that acknowledgement against your account. Whether or not you give it, cl 2.2 and cl 3 apply to you in full.
3. Prohibited uploads and content
3.1 Do not upload or enter client information, privileged or confidential material, court-restricted material, or personal information about another person. When you attach a document we show you this restriction and ask you to confirm you understand it. Confirming is a record of your agreement; it is not a check on the file's contents, and we do not inspect your uploads to enforce it.
3.2 Do not upload material you have no right to copy or share, including commercial headnotes, subscription databases, textbooks or assessment materials where that would breach copyright or licence terms.
3.3 Do not use casewise to breach academic-integrity rules that apply to you. Submitting AI-generated work as your own assessed work without permission is your responsibility, not ours, and may be misconduct under your institution's rules.
4. Accounts, plans and the free trial
4.1 You must be at least 18 years old to hold a casewise account.
4.2 You must provide accurate account information and keep your credentials secure. One account per person.
4.3 casewise is a paid subscription service. The available plans, what they include, and their current prices are shown on the plans page in the app and at checkout. Prices are in Australian dollars.
4.4 The Go plan starts with a 7-day free trial. A payment card is required to start the trial, but you will not be charged during it. When the trial ends, your subscription converts to the paid plan and the plan price is automatically charged to your payment method, and again each billing period, unless you cancel before the trial ends. The exact price and the billing period are shown beside the button before you start, and at checkout. One free trial per account.
4.5 You can cancel at any time online from Manage billing in the app, without calling or emailing anyone. When you cancel, your subscription continues to the end of the period you have paid for (or to the end of the trial, if you cancel during it) and then ends; you are not charged again.
4.6 If a payment fails at conversion or at a renewal, usage is paused immediately until payment succeeds. You can still sign in, view your saved work and manage your payment method and invoices. There is no payment grace period.
4.7 We do not offer refunds for part of a billing period: when you cancel, your access continues to the end of the period you have paid for. Nothing in this clause excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law.
4.8 Fair-use limits apply to each plan and are enforced automatically. Your plan's current limits, and your usage against them, are shown on the Usage page in the app.
5. Your content and our licence
5.1 You keep all rights in the documents, prompts and other content you submit and in the outputs generated for you, to the extent we hold any interest in them.
5.2 You grant casewise a licence to host, process, transmit and display your content solely to operate the service for you, including sending prompts and documents to the AI and infrastructure providers named in the Privacy Policy for processing on our behalf.
5.3 We do not use your prompts, uploads or outputs to train casewise or any third-party AI model. Our AI model providers are engaged on commercial API terms. Provider non-training is not the same as non-retention: providers may retain request content for abuse monitoring under their own policies and service configurations.
6. casewise intellectual property
6.1 The casewise software, product design and brand remain the property of the operator or its licensors. Legal materials retrieved and indexed by casewise (legislation and judgments) remain the property of their publishers and subject to their own terms; we claim no ownership of them, and we link and attribute to the primary source where possible.
7. Accuracy, citations and reliance
7.1 casewise may show separate evidence states, including whether a source was opened, an exact passage was inspected, or a claim was linked to a passage. One state does not prove every other state, and an evidence indicator does not guarantee that a passage supports every proposition. Treat an unchecked, unconfirmed or absent state as "not checked" and inspect the primary source yourself before relying on any citation.
7.2 Documents you export from casewise carry an educational label and warning. That label is added when the document is exported; it is not part of the stored draft, so text you copy out of the editor, or a casewise export you re-upload, will not carry it. Removing the label does not change what the document is.
7.3 You are responsible for how you use outputs. Do not rely on any output for a real matter.
8. Acceptable use
8.1 You must not: attempt to breach security or access another user's data; probe, scrape or overload the service; resell or bulk-extract the service or corpus; use the service for unlawful purposes; or attempt to generate content designed to deceive a court, regulator, institution or another person.
8.2 We may apply automated limits (rate limits and usage ceilings) to protect the service.
9. Suspension and termination
9.1 We may suspend or close an account for material or repeated breach of these Terms, unlawful use, or risk to the service or other users. Where reasonable we will warn you first and give you a chance to respond.
9.2 You may stop using the service at any time. You can cancel your subscription from Manage billing, and you can delete your account from Settings; deleting your account removes your data as described in the Privacy Policy.
10. Liability
10.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other statutory right that cannot lawfully be excluded.
10.2 Subject to cl 10.1, the service is provided "as is"; we exclude liability for indirect and consequential loss; and, where liability cannot be excluded but may be limited, we limit it to re-supplying the service. Nothing in this clause excludes liability that cannot be excluded by law.
10.3 To avoid doubt: we are not liable for consequences of using AI output in a real matter contrary to cl 2 and cl 7.
11. Privacy
11.1 Our Privacy Policy and the signup collection notice explain what we collect and how it is handled, including overseas processing by our named providers. They form part of these Terms. The version of these Terms you accepted, and the date you accepted it, are recorded against your account.
12. Changes
12.1 We may update these Terms. We will notify material changes in-product or by email at least 14 days before they take effect and show the date of the current version on this page. If a change materially disadvantages you, you may cancel and close your account before it takes effect at no cost; continued use after that date is acceptance.
13. Governing law and complaints
13.1 These Terms are governed by the law of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth courts sitting there. Nothing in this clause limits any right you have to bring a claim in another forum where the law gives you that right.
